Terms of Use

 

By consulting the site http://www.horecacareer.be(.com), called hereafter « the Site », The user unconditionally accepts the below terms of use.

 

1. User Account

When using the Site you can be asked to create an account and provide your complete and accurate personal data.

When creating a user account, you bear the full and unique responsibility for all activities that are executed out of your account on the Site.

The user acknowledges and recognizes that:

- the layout and the description of the Site can be amended without prior notice;
- the editor can unconditionally suspend the operations of the Site, be it integrally or partially, temporarily or permanently and without prior notice;
- he/she is fully responsible for not complying to his/her commitments by virtue of the Terms of Use and his liability for the results of this negligence.

2. Copyright

The complete set of elements composing the Site (texts, graphics, software, pictures, images, video’s, sound tracks, names, branding, logo’s, creations and various protected works, databases, etc...) as well as the Site as such, are submitted to the Belgian and international regulations concerning copyrights and intellectual property.

These elements belong exclusively to the editor, apart from the elements produced by external intervenient parties who did not disclaim their copyrights.

Every representation or integral or partial reproduction issued without approval of the author or the intellectual property owner is illegal. This is also the case for any translation, modification or amendment, the arrangement or counterfeit by means of an art or any other method.

The editor is the producer of the databases composing the Site. Any extract or use of the contents of these databases without explicit approval, can imply civil and judicial prosecutions towards its author. The editor reserved the possibility to engage all legal means against persons who would not have respected this ban.

The names and logotypes « horecacareer » and “Career Invest” are deposited trade marks owned by the editor. Every use of it without explicit approval of the editor, can imply civil and judicial prosecutions towards its owner.  The editor reserved the possibility to engage all legal means against persons who would not have respected this clause.

4. Protection of personal data 

The editor is responsible for handling the personal data; his details are listed below.

 

The personal data are requested and stored in a database aiming at:

-          facilitating the search for a vacancy by the users;

-          providing access to specific functionality on the Site;

-          contacting the users for information purposes;

-          identifying possibly referred counterfeit authors;

-          offering an optimal service.

 

The personal data are consciously provided by the user in context of his/her subscription to the Site.     

The collected data can be summarized as follows: IP address, First and Last Name, Gender, Age, Nationality, e-mail address, address and telephone number of the user.

The user in search of employment is granted with the possibility to put his/her curriculum vitae on the Site.

 

When submitting his/her CV, the user acknowledges that this as well as his/her personal data are subject to consultation by the editor’s clients (mainly employers or recruiters).

 

The editor can however not exclude the use of the CV database by other persons than employers or recruiters or human resource consultants. The user could therefore be approached for other reasons or by other organisations by e-mail. The editor cannot prevent these kinds of abuses.

 

The personal data of the users are not transmitted, rented or sold to third parties, be it completely or partially.

 

They can possibly be transmitted to commercial partners of the editor, unless the user withholds at the moment of his/her subscription.

The personal data are transmitted upon request of judicial or police services without prior approval of their owner.

The Site uses « cookies ». These are small data units sent by the server towards the user’s navigator. This information is stored on the hard disc of the user’s computer and is sent to the manager of the consulted site at every consultation session. In this way, the Site is able to easily identify the user as a customer, which keeps off the user to re-enter systematically his/her user name and password. The user of the Site acknowledges the use of these cookies.

The Site collects also information in register files (the so-called « log files »), such as the IP address of the user’s computer. This information can be used for internal purposes such as the analysis of the traffic and the profile, in order to optimize the service offering and streamline it to the users’ needs.

The user can at any time withhold from entering his/her personal identification data on the Site; he can modify or remove them.

The user can at any time amend his/her profile and e-mail address on the page of his/her user account or by means of an e-mail to be sent to the person in charge for the handling of data and whose details are provided above.

 

 

5. Liabilities

The editor is not responsible:

  • When the Site is being interrupted for technical maintenance purposes or when the edited information is being refreshed after an update;

  • When temporary access to the Site (and/or linked sites) is not possible  in case of technical defects, notwithstanding the reason or source;

  • When direct or indirect prejudice is done on the user, notwithstanding the kind and resulting from the content, the access or the use of the Site (and/or linked sites);

  • Abnormal use of illegal operation of the Site. The user is fully responsible for the prejudice towards third parties and for the outcome of the complaints or actions that might be undertaken in this context. The user also acknowledges not prosecuting the editor in case of legal actions that are taken against the user by third parties and resulting from illegal use and/or operations of the Site. 
     

6. Hyperlinks

 

The Site can contain hyperlinks to external sites. These links are purely for information purposes. The editor does not perform any controlling action on these sites and is by no means liable for access, contents or use of them or for the prejudice that might  result from consulting available information on these sites. The activation of these hyperlinks is under the full responsibility of the internet user.

No hyperlink to the Site can either be created without prior approval of the editor.

In case an internet user or a moral person intends to create a hyperlink to the Site on his/her site, prior contact will be taken with the editor whose details are mentioned below. The decision on the acceptance or refusal of such a request will be transmitted in due course to the interested party.

 

7.  Modifications to the Terms of Use

The editor reserved the right to modify freely the Terms of Use at every moment. Every internet user who is logging in on the Site is invited to consult the current terms of use on a regular basis in order to be aware of possible amendments. The repetitive use of the site according to the updates of these terms of use, ratify the acknowledgement, by every user of the applicable Terms of Use.

 

8.  Disputes – Applicable Law

Any dispute related to the validity, the interpretation, the acceptance and the execution of underlying terms, notwithstanding the location of the registration or regulation, will be subject to a proposal for mutual and amicable settlement upon which the parties are being invited to sign in. In case this attempt proves to be unproductive within a period of one month, the Brussels Court remains the only competent authority, even in case of warranty claim or multiple defenders.

The current terms are submitted to the Belgian Law.
